What is Article 121 of UAE Labour Law?

In the United Arab Emirates (UAE), the Labour Law plays a crucial role in regulating the relationship between employers and employees. One of the key provisions of this law is Article 121, which deals with the termination of employment contracts. In this blog post, we will discuss Article 121 in simple terms to help you understand your rights and obligations under the UAE Labour Law.

Article 121 states that an employer has the right to terminate an employment contract without notice if the employee commits any of the following acts:

  1. If the employee adopts a false identity or nationality or submits forged documents.
  2. If the employee is engaged in any act of dishonesty or breach of trust.
  3. If the employee commits an assault on the employer, the manager, or any of his colleagues.
  4. If the employee is found in a state of drunkenness or under the influence of a narcotic drug during working hours.
  5. If the employee commits a violation of the instructions regarding safety at work or in the workplace, provided that such instructions are in writing and have been posted in a prominent place, and the employee is aware of them.
  6. If the employee fails to perform his basic duties under the contract of employment and persists in violating them despite a written investigation and warning from the employer.
  7. If the employee reveals any confidential information related to the work, except as required by the nature of his work.

It is important to note that Article 121 lists specific grounds for termination without notice. In other cases, the employer is required to provide the employee with a notice period or compensation in lieu of notice, as per the provisions of the UAE Labour Law.

If you believe that your employment has been terminated unfairly or in violation of the UAE Labour Law, you have the right to file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE). The MOHRE will investigate your complaint and take appropriate action to resolve the issue.

In conclusion, Article 121 of the UAE Labour Law outlines the grounds for the termination of employment contracts without notice. It is important for both employers and employees to be aware of these provisions to ensure that their rights are protected under the law.
